These Terms of Service ("Terms") govern your use of the services provided by Legacy Home Solutions AZ, LLC (referred to as "Legacy Home Solutions," "we," "us," or "our"). By requesting, scheduling, or receiving home maintenance or remodeling services (the "Services"), you agree to be bound by these Terms.
1. Services Provided
We agree to perform the home maintenance, remodeling, or repair services as specifically outlined in a separate, written Service Agreement, Work Order, or Estimate provided to you.
Detailed Scope of Work: The specific details of the work to be performed, materials to be used, and the estimated duration of the service will be detailed in the Estimate/Work Order.
Changes to Scope: Any requested changes to the scope of work must be agreed upon in writing by both parties and may result in adjustments to the price and/or completion timeline.
2. Compensation & Payment Terms
You agree to pay Legacy Home Solutions the fees for the Services as outlined in the provided Estimate or Work Order.
Payment Rate: Payments shall be made based on a flat-rate fee, or an hourly labor charge, as listed in the Estimate.
Deposit: A deposit of 50% may be required prior to the commencement of any work.
Payment Schedule: Payment is due upon completion of service.Late Payments: Invoices not paid within 15 days of the due date may be subject to a late fee of 2.5% per month on the unpaid balance.
Taxes: All stated prices are exclusive of any applicable sales tax, which will be added to the final invoice where required by law.
3. Client Responsibilities
To ensure the smooth execution of the Services, you, the client, agree to:
Provide safe, unimpeded access to the property and areas where the Services are to be performed.
Provide timely feedback, necessary decisions, and information required to keep the project on schedule.
Ensure that any necessary utilities (e.g., water, electricity) are available for our team's use.
4. Cancellation & Termination
Client Cancellation: If you need to cancel or reschedule a service, you must provide at least 48 hours notice. Cancellations made outside of this period may forfeit any deposit or incur a 10% cancellation fee.
Our Right to Terminate: We reserve the right to terminate the Services or this Agreement if you breach these Terms (e.g., non-payment) or if unsafe working conditions are encountered.
5. Warranties & Limitation of Liability
Warranties: We warrant that all Services will be performed in a professional manner consistent with accepted industry practices.
Disclaimer: We disclaim all other warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
Limitation of Liability: Legacy Home Solutions AZ, LLC shall not be liable for any indirect, incidental, special, or consequential damages (including, without limitation, damages for loss of profits, property damage, or personal injury) arising out of or in connection with the Services. Our total liability to you for any claim arising from the Services shall not exceed the total amount paid by you for the specific Services.
6. Governing Law & Dispute Resolution
This Agreement shall be governed by the laws of the State of Arizona. Any disputes arising under these Terms shall first be attempted to be resolved informally through good-faith negotiation. 7. Intellectual Property
